Right of Way (RoW) Realities: Evaluating the Impact of the Lekki Regional Road on Encroaching Properties

In the Lagos real estate market, there is a dangerous sentiment that "proximity is profit." While generally true, this assumption often blinds investors to the surgical precision of urban planning. In the Lekki corridor, thousands of investors currently sit on ticking time bombs—assets they believe are appreciating due to the Lekki Regional Road construction, but which are actually slated for partial or total demolition.

At Zikan Prop Solutions, we have observed a recurring pattern: the speculative buyer chases the "front row" without verifying where the row actually starts. In Lagos, infrastructure doesn’t just add value; it redefines boundaries. If you are holding property within the Regional Road's alignment without a deep understanding of Right of Way (RoW) enforcement, you aren't an investor; you are a placeholder for the government’s bulldozers.

The Architecture of the Lekki Regional Road

The Lekki Regional Road is not a mere "neighborhood improvement" project. It is a strategic 8.75-kilometer arterial link designed to de-congest the Lekki-Epe Expressway by connecting VGC (Victoria Garden City) to Freedom Way in Lekki Phase 1.

Unlike the primary expressway, which has been established for decades, the Regional Road carves through semi-developed and fully built-up micro-markets including Ikate Elegushi, Ikateland, and the northern borders of Chevron. The engineering requirement for a road of this magnitude necessitates a standard width that rarely aligns with the optimistic fencing of private developers.

The Illusion of "Global C of O"

One of the most expensive mistakes we see in the Lagos market is the reliance on a "Global Certificate of Occupancy." Many investors purchase plots within estates that claim to have valid titles, assuming the developer has factored in all government setbacks.

In reality, many "Global C of O" documents were issued long before the final engineering survey for the Regional Road was gazetted. When the Lagos State Ministry of Physical Planning and Urban Development (MPP&UD) marks a building for "Encroachment," the fact that you have a Governor’s Consent or a C of O does not stop the demolition. It only determines whether you are eligible for compensation—and even then, compensation is often a fraction of the market value, excluding the "emotional premium" or the projected ROI.

Micro-Market Logic: Winners and Victims

The impact of the RoW enforcement is not uniform across the corridor. It creates a stark divide between properties:

  1. The High-Risk Encroachers: Properties in certain pockets of Ikateland and the back-sections of Chevron Drive are currently the most vulnerable. We have seen structures where the RoW takes out the mandatory front-yard setback, rendering the building non-compliant with fire safety and parking regulations. Once a property loses its parking or its "setback integrity," its rental yield collapses.

  2. The Strategic Beneficiaries: Conversely, properties located 50 to 100 meters behind the RoW line are the true "Goldilocks" investments. They gain the accessibility of the new road without the risk of structural intervention. Smart money is currently moving away from the "immediate road-front" and deeper into well-surveyed interior plots that will soon feature prime accessibility.

The "Cost of Silence" in Transactions

In our consultancy at Zikan Prop Solutions, we often deal with "distress sales" that aren't actually caused by financial hardship, but by insider knowledge. We have tracked instances where developers, aware that their perimeter fences or even first-floor balconies infringe on the gazetted 50-meter or 90-meter RoW, rush to sell these units to unsuspecting diaspora investors.

The red flag is often in the price. If a luxury terrace in a "prime" location is priced 15% below the market average for that specific street, it is rarely a bargain. It is usually an exit strategy for a seller who has seen the surveyor’s marks.

Insider Insight: In Lagos, the "Red Mark" is not the beginning of the problem; it is the final warning. The problem began the moment the survey was lodged without checking the Lagos State Master Plan.

A Framework for Risk Mitigation

To navigate the Lekki Regional Road expansion—or any major Lagos infrastructure project—investors must adopt a technical framework rather than an emotional one.

  • The Charting Mandate: Never conclude a transaction based on the seller's survey. Conduct an independent "Charting" at the Surveyor General’s office to see how the coordinates sit against the proposed road alignment.

  • The Setback Buffer: Lagos state laws vary. For a major regional road, the required setback is often more significant than a standard street. If your developer is building right up to the drainage line, you are at risk.

  • Structural Integrity Post-Severance: If the government takes 5 meters of your 10-meter frontage, can the remaining structure still function? Many investors forget that even if the whole house isn't demolished, the loss of a gatehouse or parking area can make a property un-leasable to high-value tenants.

The Zikan Perspective: Intelligence Over Speculation

The Lekki Regional Road will undoubtedly transform the peninsula, turning previously "inaccessible" land into high-yield commercial and residential hubs. However, the transition will be violent for those who ignored the regulatory landscape.

At Zikan Prop Solutions, we don't just look at what is on the ground today; we look at what the government intends to put there tomorrow. Our role is to act as the "technical conscience" for our clients. We have walked away from high-commission deals because our internal due diligence showed that the property sat 2 meters into the future RoW. For us, an award-winning reputation is built on the losses we help our clients avoid, not just the gains we help them realize.

The Regional Road is a masterclass in the necessity of market intelligence. As the asphalt meets the soil, the distinction between those who "bought land" and those who "invested in real estate" will become painfully clear.

Investors must realize that in the high-stakes environment of Lagos infrastructure, the most expensive advice is the advice you didn't seek before signing the contract. Whether you are looking at Ikate, Chevron, or North-Leads, ensure your capital is protected by data, not just dreams.

Consulting with a firm that understands the intersection of civil engineering, urban planning, and property law is no longer a luxury—it is the only way to ensure your asset survives the evolution of the city.
